This petition under Section 439 (2) of the Code of Criminal Procedure, 1973, is filed by the petitioner-de facto complainant for cancellation of pre-arrest bail granted to respondent No. 2accused by order dated 02-02-2018 in Criminal Miscellaneous Petition No. 230 of 2018 on the file of the Court of Additional Metropolitan Sessions Judge, Cyberabad at L.B. Nagar, Ranga Reddy District (for short, 'the Court below'), in Crime No. 1007 of 2017 of Medipally Police Station, Rachakonda, registered for the offences punishable under Sections 376, 420 and 506 of IPC and Section 67 of I.T. Act.

The Court below by the abovementioned order granted pre-arrest bail to respondent No. 2, cancellation of which is now sought in the present petition. Therefore, the petition is required to be filed before the Court below which granted prearrest bail to respondent No. 2 in view of convention. Hence, the petition is liable to dismissed.

The criminal petition is accordingly dismissed with liberty to the petitioner to file the same before the Court below. Pending miscellaneous petitions if any shall stand dismissed in consequence.
