THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 7679 of 2018 O R D E R:

This writ petition is filed for the following relief: "... to issue a Writ, Order or Direction more particularly one in the nature of Wirt of Mandamus declaring the action of the 3rd respondent in issuing the Notification No F/394/2018 dated 22.02.2018 issued by the 3rd respondent calling applications Permanent Fair price shop dealer of Open Category (Women) including in respect of the petitioner shop bearing Shop No 44 (0813044) Lankojanapalli Village, Darsi Mandal, Kandukuri Division, Prakasam District which was allotted under First Leader of Lakshmi Self Help Group for welfare of the members of the group and without following the guidelines prescribed for selection and appointment of the fair price shop dealer under the Andhra Pradesh State Public Distribution System (Control) Order 2008 revised guidelines in G.O.Ms.No. 4, dated 19.02.2011 as per amendment in G.O.Ms.No.39, dated 22.09.2012 and without following the rule of reservation is illegal unjust and arbitrary and liable to be set aside in the interest of justice. ..."

When the matter is called, it is represented by the learned counsel for the petitioner as well as learned Government Pleader for Civil Supplies that today, in similar circumstances, this Court disposed of W.P.No.7499 of 2018, operative portion of which reads as under:

"In the circumstances, the writ petition fails and is, accordingly dismissed. However, it is made clear that the petitioner may be continued to discharge the functions till fresh appointment is made."

Following the above said order and for the reasons recorded therein, this writ petition is also dismissed. However, it is

made clear that the petitioner may be continued to discharge her functions as fair price shop dealer till fresh appointment is made. Miscellaneous petitions, if any, pending shall stand dismissed. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:14.03.2018 kdl
