HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.26640 OF 2010 ORDER:

The petitioners seek writ of Mandamus declaring the action of respondent bank in proposing to deduct from the crop loan amounts crop insurance premium as well as weather insurance premium in respect of Crop Loans sanctioned or to be sanctioned at the prescribed rates for the Kharif and Rabi seasons 2010-2011 under National Agricultural Insurance Scheme as well as Weather Based Crop Insurance Scheme without the consent of the petitioners as arbitrary, irrational, discriminatory, ultravires to the debit contractual terms, unfair and without jurisdiction and violative of Articles 14 and 21 of the Constitution of India, apart from being violative of principles of natural justice and consequently direct the respondent not to insist upon the petitioners to pay the insurance premium on the loans advanced and to be advanced to them and pass such other order.

When the matter is called, learned counsel for petitioners submits that the subject matter in the writ petition has become infructuous since the relief sought for in the present writ petition is pertaining to the crop period for the years 2010-2011, which was over long back.

Recording the said submission, this writ petition is dismissed as infructuous. As a sequel, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
