Heard both sides. With the consent of both parties the writ petition is disposed of at the admission stage.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondents in not initiating any action despite registering F.I.R.No.1346 of 2015 on 23.10.2015, on the complaint made by the petitioner and not securing the presence of the petitioner's wife and child despite knowing the whereabouts of her with respondent No.3, as illegal and arbitrary. 3.
At the time when the matter is taken up for hearing, learned Government Pleader for Home, placed before the Court, the instructions received by him from Rachakonda Commissionerate, wherein it is mentioned that the police have made possible efforts to trace out the missing woman, but she could not be traced. It is also stated that the missing woman is also not at the house of respondent No.3 and that respondent No.3 is also not aware of the whereabouts of the missing woman. It is further stated that the investigation revealed that respondent No.3 is not responsible for missing of the wife of the petitioner. In view of the above circumstances, the Assistant Commissioner of Police, L.B.Nagar Sub-Division, Rachakonda requested to accord permission to refer the case as "UN for time being" and permission was accorded on 30.03.2017. Accordingly, final report referring the case as "UN for time being" was filed before the Hon'ble II Metropolitan Magistrate, L.B.Nagar, Rachakonda. 4.
That being the position, the writ petition is closed, giving liberty to the petitioner to avail the remedies available under law. No costs.
