THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.11813 OF 2014 ORDER:

This Writ Petition is filed seeking writ of mandamus declaring the inaction and inordinate delay caused by the 3rd respondent in disposing of the petitioner's appeal vide Appeal No.___of 2013, dated 23.12.2013, as arbitrary and illegal and consequently direct the 3rd respondent to number the appeal and dispose of the same expeditiously.

Heard learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for respondents 1 to 4.

As can be seen from the record, the petitioner filed an appeal under Section 5 of the A.P Rights in Land and Pattadar Pass Books Act, 1971, before 3rd respondent, for mutation of entries in the revenue records on 23.12.2013. According to the petitioner, the said appeal is not even numbered. Hence, he prays to issue a direction to the 3rd respondent to number the appeal and dispose of the same expeditiously. 4.

In view of the submissions made by the petitioner, this Writ Petition is disposed of directing the 3rd respondent to number the appeal said to have been filed by the petitioner on 23.12.2013, and dispose of the same after hearing both sides, as expeditiously as possible, but not later than twelve (12) weeks from the date of receipt of a copy of this order, if the said appeal is not already numbered and disposed of.
