HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.7736 of 2018 ORDER: (Oral) (Per Suresh Kumar Kait, J) Heard learned counsel for the petitioner as well as the learned Govt. Pleader appearing on behalf of the respondents and with their consent, the writ petition itself is disposed of at the admission stage. Vide the present petition, petitioner has challenged order dated 15.02.2018 passed in O.A.No.258 of 2018, whereby the application filed by the petitioner under Section 19 of the Administrative Tribunals Act, 1985 has been dismissed.

The petitioner is working as Assistant Commissioner, Tadepalligudem Municipality and before that he worked as Municipal Commissioner, Pedana Municipality. While so, petitioner together with five others were kept under suspension by the Government vide G.O.Rt.No.15 Municipal Administration and Urban Development (Vig.III) Department dated 04.01.2018 on the ground that all of them allowed unauthorised layouts by colluding with realtors in Pedana Municipality in RS Nos.353, 28/11G, 301/1, 2 & 3; 479/6A, 479/3, 4 & 5; 482/1B, 3 & 4, without collecting developmental charges and 10% open space charges. As per letter ROC No.1055/10-G1 dated 20.01.2016 of the Commissioner, Pedana Municipality addressed to Regional Vigilance and Enforcement Officer, Vijayawada, the unauthorized layouts in Pedana Municipality from the year 2010 onwards were 19 in number. After enquiry, Director General, General

SKK, J & AKS, J W.P.No.7736 of 2018 Administration (Vigilance and Enforcement) Department, gave vigilance report dated 06.09.2017 to the Government on the subject. Thereupon, the Government took steps for suspending the petitioner herein and other five Municipal employees who worked at Pedana Municipality during that time, vide G.O.Rt.No.15 dated 04.01.2018. Similar issue came before this Court in W.P.No.3208 of 2018 and the same was disposed of vide order dated 05.02.2018 by granting liberty to the petitioner therein to file representation before the Government for revocation of suspension. It appears, petitioner herein has already filed representations on 05.02.2018 and 12.02.1018, however, till date, respondents have not taken any decision on the said representations.

Without going into merits of the case, we hereby direct the respondents to take a decision on the representations of the petitioner mentioned above within three weeks from the date of receipt of this order and communicate the decision taken, to the petitioner within a week thereafter.

Writ petition is accordingly disposed of. No order as to costs. Miscellaneous petitions, if any pending in the writ petition, stand closed.
