THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.42671 of 2015 ORDER:

The grievance of the petitioners was that the police authorities were not completing the investigation in Crime No.1510 of 2014 on the file of Banjara Hills Police Station, Hyderabad, as per the direction of the learned III Additional Chief Metropolitan Magistrate at Nampally, Hyderabad.

Written instructions dated 21.01.2016 were furnished by the Inspector of Police (Crimes), Banjara Hills Police Station, Hyderabad, to the office of the learned Government Pleader for Home, wherein he stated that Crime No.1510 of 2014 had been registered upon the complaint of the petitioners being forwarded under Section 156(3) Cr.P.C. by the learned III Additional Chief Metropolitan Magistrate at Nampally, Hyderabad. This crime was registered under Sections 420, 423, 447, 468 & 471 I.P.C. read with Section 120(B) I.P.C. However, upon completion of investigation, the police authorities found that there was a dispute between the complainant and the GHMC/Revenue Department and that it was purely civil in nature. Accordingly permission was obtained from the Assistant Commissioner of Police, Banjara Hills Police Station, Hyderabad, and after giving due notice to the complainant, the final report was filed before the learned III Additional Chief Metropolitan Magistrate at Nampally, Hyderabad, vide SR.No.401 of 2015 dated 19.01.2016 referring the case as 'civil in nature'.

In the light of the aforestated developments, the grievance of the petitioners as to the alleged inaction of the police authorities in completing the investigation stands settled. If the petitioners are aggrieved by the final conclusion arrived at by the police authorities, it is for them to take recourse to appropriate remedies in accordance with law.

Reserving liberty to the petitioners to do so, the writ petition is

dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
