HON'BLE SRI JUSTICE S.V. BHATT W.P. No.33732 OF 2017 ORDER:
Heard Mr.V. V. Anil Kumar and Mr.K.Lakshman for parties. Mr.Lakshman objects to the maintainability of writ petition on the ground that the petitioner has effective statutory remedy of appeal under Section 252 of the Companies Act (for short 'the Act') before the Tribunal.
After hearing the learned counsel for sometime, particularly having regard to the facts in issue, this Court is of the view that the case ought to be relegated to the Tribunal and the petitioner has to workout the grievance by filing appeal under Section 252 of the Act.
The writ petition is disposed of permitting the petitioner to work out the remedy by filing appeal before the Tribunal. All the contentions are left open for parties before the Tribunal. No order as to costs.
