HONOURABLE SRI JUSTICE RAJA ELANGO Criminal Revision Case No.583 of 2015 and Criminal Revision Case No.1477 of 2013 COMMON ORDER:

These revisions are filed against the order dated 18-062013 passed in F.C.O.P. No.13 of 2012 by the Judge, Family Court, Adilabad District, wherein and whereby the learned trial Judge directed the respondent therein to pay maintenance at the rate of Rs.3,000/- per month to the petitioner therein and further the respondent therein was directed to pay Rs.500/- towards the costs of the petition.

Criminal Revision Case No.583 of 2015 is filed by the respondent-son in the trial Court to set aside the impugned order, whereas Criminal Revision Case No.1477 of 2013 is filed by the petitioner-mother in the trial Court to modify the impugned by enhancing the maintenance from Rs.3,000/- per month to Rs.6,500/- per month.

Both revisions are heard together.

The contention of the petitioner in Criminal Revision Case No.583 of 2015 is that the petitioner in Criminal Revision Case No.1477 of 2013 is also having another son, who is younger to him, and the petitioner-mother without claiming any maintenance from him, she is claiming maintenance only from

him. Further, it is his case that his mother and her younger son colluded together and filed the maintenance petition with an intent to harass him.

The contention of the petitioner in Criminal Revision Case No.1477 of 2013 is that in the present situation the amount ordered is very meager and hence it has to be enhanced. It is further contended by the learned counsel for the petitioner in Criminal Revision Case No.583 of 2015 that the petitioner is a married man and he has wife and children, therefore, he has to maintain them also.

Considering the facts and circumstances of the case, this Court is of the view that the order dated 18-06-2013 in F.C.O.P.No.13 of 2012 passed by the learned Judge, Family Court, Adilabad District, is in accordance with law. Hence, both Criminal Revision Cases are dismissed. Consequently, miscellaneous petitions pending, if any, in these revisions are closed.
