HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.3563 of 2015 ORDER:
This criminal petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'the Code') by the petitioners, who are arraigned as accused Nos.1 to 3 in Crime No.24 of 2011 of AS Peta Police Station, Nellore District, for the offences punishable under Sections 419, 120-B, 406, 420 and 468 I.P.C., requesting to quash the proceedings against them in the said crime.
2. During the course of arguments, learned Additional Public Prosecutor represents that the very de facto complainant, who is the 2nd respondent herein, has submitted a letter to the Investigating Officer, who is Sub Inspector of Police, requesting to close the complaint, on which, the Sub Inspector of Police has recorded that it was a 'mistake of fact' and requested for closure, and, thus, the final report has been pending with the Inspector of Police for his approval.
3. Learned counsel for the petitioners seeks permission of the Court to withdraw the instant criminal petition.
4. Permission is accorded, and, accordingly, the criminal petition is dismissed as withdrawn.
5. As a sequel thereto, miscellaneous petitions, if any pending in this petition, shall stand closed.
