THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.23207 OF 2004 ORDER:

When the matter is taken up for hearing, it is noticed that the present Writ Petition against respondent No.3 - Nalla Janardhan S/o Lingaiah was dismissed for default, by order, dated 23.08.2010, and the petitioner has not taken any steps to ensure that the writ petition against respondent No.3 is restored. The petitioner filed the present writ petition challenging the order, dated 24.11.2004, passed by respondent No.2 in I.A. No.1 of 2004 in M.W. No.38 of 2004 in favour of respondent No.3 by the Authorities under Minimum Wages Act, 1948. In the absence of respondent No.3, the matter cannot be adjudicated on merits.

With the above observation, the present Writ Petition is dismissed. However, in the circumstances of the case, there shall be no order as to costs.

As a sequel thereto, Miscellaneous Petitions, if any, pending in the present writ petition stand closed.
