THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9846 OF 2015 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/A.1 seeking grant of anticipatory bail in crime No.136 of 2015 on the file of the Mannur Police Station, Rajampet, Kadapa District, registered for the offences under Sections 147, 148, 324, 307, 302 read with Section 149 IPC.

Heard and perused the material available on record. The allegation against the petitioner herein is that he along with the others bet the de facto complainant with sticks and abused him in filthy language, in view of the dispute between the de facto complainant and the accused, and as a result of which, he died while undergoing treatment. This Court is of the view that the name of the petitioner/A.1 found place in F.I.R. Further, the de facto complainant died while undergoing treatment and as the offences are serious in nature, this Court is not inclined to grant anticipatory bail to the petitioner/A.1.
