THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 1607 of 2016 O R D E R :
Complaining that the respondent has flouted the order dated 12.04.2016 in Writ Petition No. 10664 of 2016, this Contempt Case has been filed.
The order dated 12.04.2016 reads as under:
" Learned Government Pleader submits that it is the Executive Officer, who has to implement the orders of the Assistant Commissioner, and that the Assistant Commissioner has already directed the Executive Officer.
Learned standing counsel once again seeks time. I am not inclined to grant time as on earlier occasion also time was granted and the very term itself is up to 30.06.2016. In that view of the matter, notice before admission. There shall be interim direction as prayed for. Post after summer vacation, 12016."
The respondent has filed a counter-affidavit along with a copy of the resolution dated 25.06.2016, whereunder the Committee had resolved that on account of the fact that the petitioner had already taken oath on 18.04.2011, there is no requirement of taking oath any further. In those circumstances, in view of the stand taken by the Committee, the very order in the Writ Petition becomes superfluous. Hence, this Contempt Case is closed.
Registry is directed to list Writ Petition No. 10664 of 2016 before the appropriate Court, as the relief claimed in the main Writ Petition itself stands granted on account of the stand taken by the respondent, after obtaining necessary orders from the Hon'ble the Acting Chief Justice.
