Order : (Per Hon'ble Sri Justice C.V.Nagarjuna Reddy) Order, dated 01-06-2016, of the Central Administrative Tribunal, Hyderabad Bench at Hyderabad (for short 'the Tribunal') in OA.No.514 of 2016, whereby it has declined to suspend the transfer of the petitioner from Hyderabad to Izatnagar, Bareli, is questioned in this Writ Petition. Though Mr.J.Sudheer, learned Counsel for the petitioner, has advanced elaborate submissions, we feel that it is not appropriate for us to dwell into the same at this stage for the reason that the main OA is still pending before the Tribunal and it would be in fitness of things that the Tribunal considers all the pleas of the petitioner and takes a final decision thereafter.
At this stage, the learned Counsel for the petitioner requested that since the transfer of the petitioner was made at the instance of respondent No.2, who was impleaded as eo nomini party as respondent No.3 before the Tribunal as well as here, the Tribunal may call for the records pertaining to the petitioner's transfer from
respondent Nos.1 and 2 and dispose of the OA based on those records.
As we find the above request of the learned Counsel for the petitioner reasonable, without interfering with the impugned order of the Tribunal, we dispose of the Writ Petition with a request to the Tribunal to dispose of OA.No.514 of 2016, after calling for the records pertaining to the petitioner's transfer from respondent Nos.1 and 2, as expeditiously as possible and not later than 31-082016.
