This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri N. BHUJANGA RAO, Advocate for the Petitioner and the Additional Public Prosecutor on behalf of the Respondent No.1 and of Sri SINGAIM SRINIVASA RAO, Advocate for tre Respondent No.2, The Court made the following: ORDER

This Criminal Petition is filed under Section 482 oF the Code of Criminal Procedure, t973 (for short 'Cr.P.C.') by the petitioner-Accused No.1 seeking to quash the proceedings against him in FIR No.19 of2022 pending on the file of Station House Officer, Wanaparthy Rural Police Station, Wanaparthy District.

Heard learned counsel for the petitioner-Accused No.1 and learned Additional Public Prosecutor for the respondent-State. Perused the material on record.

3. The case of the respondent No.2 - de facto complainant is that false documents were prepared by the Accused with the assistance of t Village Revenue Officer of Rajapet Village and others. For the said I fabrication of unregistered sale deed document dated 02.12.2009 showing that the respondent No.2 - complainant has affixed his thumb I impression, the present complaint is filed.

As seen from the allegations, the incident happened in the year 2009 and the said case is based on documents.

Crl.Petition No.2373 of 2022 5, For the said reason, this Court deems appropriate to direct the Investigating Officer in respect of FIR No.19 of 2022 pending on the file of Station House Officer, Wanaparthy Rural Police Station, Wanaparthy District to conclude the investigation without arresting the petitionerAccused No. 1.. Further, the petitioner shall co-operate with the Investigating Officer as and when required for the purpose of investigation. Needless to say, the documentary evidence produced by the petitioner at the time of investigation shall be considered by the Investigating Officer.
