This Criminal Petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking to enlarge the petitioner/Accused on bail in connection with C.O.R.No.96 of 2021 on the file of Andole Police Station Excise registered for the offence punishable under Section 8(b) read with Sections 20(a) and 20(b)(i) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NDPS Act'). 2.

Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor for the respondent-State and perused the record.

Briefly the facts of the case are that on 04.10.2021 the Excise Andole found cultivation of ganja, destroyed 60 plants by drawing two sample plants. Thereafter petitioner/Accused arrested on 01.02.2022 as he was identified as the owner of the land.

Learned counsel for the petitioner/Accused submits that the petitioner/Accused has nothing to do with the land in question and he is in jail since 60 days.

In the said circumstances, the Criminal Petition is allowed and the petitioner/Accused is granted bail subject to the following conditions:

i) The petitioner/Accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties for a like sum each to the satisfaction of I Additional District and Sessions Judge, Medak at Sanga Reddy.

ii) The petitioner/Accused shall appear before the investigating authorities on every Sunday between 08.00 AM and 11.00 AM for a period of three (03) months or till filing of the charge sheet, whichever is earlier.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
