THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.26581 of 2011 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking a Writ of Mandamus declaring the action of the fifth respondent in contemplating to initiate a departmental enquiry without obtaining the approval of the CRPF IGP, that too during the pendency of W.P.No.19358 of 2010 filed for release of pensionary benefits, as arbitrary, illegal, unconstitutional and violative of principles of natural justice.
As there was no representation for the petitioner on 26.06.2018, this Court directed the matter to be listed today under the caption "for dismissal". Yet again, there is no representation for the petitioner.
Learned Standing Counsel for the Central Government submits that the petitioner was permitted to voluntarily retire from service as per the order, dated 04.04.2012, and that, in that view of the matter, no cause survives for adjudication in this Writ Petition.
Having regard to the submissions and the conduct of the petitioner, which reflects that she is not interested in prosecuting the Writ Petition, the Writ Petition is dismissed for default.
