HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.4064 of 2017 ORDER:

This petition is filed under Section 438 of Cr.P.C. by the petitioners-accused Nos.1 and 2 seeking pre-arrest bail in Crime No.84 of 2017 of Bellampalli Town Police Station, Ramagundam District, which was registered against them for the offences punishable under Sections 452 and 380 read with 34 IPC. 2.

Both the petitioners are employees in the office of the Municipal Commissioner, Bellampalli. The accusation is that on 12.05.2017, both the petitioners forcibly entered the Old Municipal Office, situated in front of the Court and they broke open the lock of the Government cash chest existing in the Old Municipal Office with the help of crow-bar and other iron implements and took away some files kept in the chest. Their outrageous act was witnessed by the Sanitary Inspector namely R.Kistaiah and intimated the said fact to the Municipal Commissioner, who reported the matter to the police. 3.

The statements of the Municipal Commissioner and the Sanitary Inspector shed a strong prima facie accusation against the petitioners. Investigation is reported to be pending. As such, having regard to the nature of the accusation and pending investigation, it is not a fit case to grant anticipatory bail to the petitioners. While dismissing the criminal petition, the petitioners are directed to surrender before the concerned Magistrate and seek for regular bail.

In which case, the concerned Court shall dispose of their bail application on merits, on the same day.

With the above observation, the criminal petition is dismissed. 5.
