HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.9403 of 2019 ORDER:

This writ petition is disposed of at the stage of admission with the consent of both the parties.

This writ petition is filed seeking the following relief :- " ...... to issue an order, direction or writ more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not paying the terminal benefits to the petitioner consequent to the termination order dated 03.09.2018 as same is illegal, arbitrary and unjust and consequently direct the respondents to pay terminal benefits ...." Heard Mr.G.Ravi Mohan, learned counsel for petitioner and Sri N.Vasudeva Reddy, learned Standing Counsel for respondents. It has been contended by the petitioner that he was initially appointed as Conductor during July, 1988 and later on, he was promoted as Assistant Depot Clerk. The respondents have removed him from service vide order dated 03.09.2018 on the alleged cash and ticket irregularities.

As per the Regulations of the respondents, they are bound to pay service benefits to the petitioner for the service rendered by him from the date of his initial appointment till the date of removal. But, the respondents are not paying retiral benefits to the petitioner. Therefore, the petitioner has submitted a representation to the respondents on 29.11.2018. But, so far, the respondents have not passed any orders on the said representation nor released terminal benefits to the petitioner.

This Court, having considered the rival submissions, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 29.11.2018 and pass appropriate orders in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
