WRIT PETITION Nos.12419 of 2005 ORDER:

On 04.02.2015, this Court passed the following order: "Learned counsel for the petitioners, requests one week time to file reply to the counter filed by the 5th respondent, more specifically with reference to service of notice under the Land Encroachment Act (for short 'the Act').

Learned Government Pleader is also directed to produce the relevant records, concerning the notice issued under the Act, and the orders passed there in. Post on 16.02.2015."

2. When the matter is called, Smt. N. Yashoda Kumari, learned counsel representing on behalf of the learned counsel for the petitioners submitted that the learned counsel for the petitioners has not received any instructions from the clients, implying thereby that the petitioners are not interested to contest the matter.

3. Recording the same, the Writ Petition is dismissed for non-prosecution. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
