THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER Criminal Petition No.2444 of 2022 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioners/A1 & A2 for grant of anticipatory bail in Crime No.256 of 2021 of Narketpally Police Station, Nalgonda District, registered for the offence under Section 379 of IPC.

Heard both sides. Perused the record.

It is evident from the material placed on record that the petitioners/A1 & A2 were made accused in this case basing on the confession made by A3 in this case from whom, the stolen property, i.e., diesel worth Rs.30,000/- was recovered. It is also brought to the notice of this Court that charge-sheet has been filed in this case. Under these circumstances, this Court is inclined to grant pre-arrest bail to the petitioners/A1 & A2 on the following conditions: (i) The petitioners/A1 & A2 are directed to surrender before the Judicial Magistrate of First Class (Excise & Prohibition) at Nalgonda, within a period of one (1) week from the date of this order.

(ii) On such surrender, the said Magistrate shall release the petitioners/A1 & A2 on bail, on each of them executing a personal bond for a sum of Rs.20,000/- (Rupees twenty

thousand only) with two sureties for a like sum each to his satisfaction.

The Criminal Petition is, accordingly, allowed. Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
