THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.32435 OF 2017 Dated:22.09.2017 Between:
M. Nageshwar Rao, S/o. M. Ramu, Aged 37 years, R/o. Door No.10116, Kotanarava Village, Narava Post, Pendurthi Mandal, Visakhapatnam .. Petitioner And The State of Andhra Pradesh, Rep., by its Principal Secretary, Revenue Department, Secretariat, Velapaudi, Amaravathi, Guntur District and others .. Respondents The Court made the following:
THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.32345 OF 2017 ORDER:
Heard.
2.
Petitioner alleges that a small extent of land admeasuring 300.66 sq. yards in Survey No.296 of Narava Village, Pendurthi Mandal, Visakhapatnam District, belongs to him. The grievance of the petitioner is that the respondents are trying to dispossess him from the said property.
3.
The material enclosed to the Writ Petition would disclose that except a Gift Settlement Deed granted in favour of the petitioner, no other material would establish some semblance of right in the petitioner to occupy the said property. Moreover, the photographs would disclose that a small temporary shed was erected to show as if the petitioner is in occupation of the said property. This material is not sufficient to grant the relief in favour of the petitioner.
4.
If the petitioner has sufficient material to show that he is in occupation of the subject property, it is open to him to make a representation to the Tahsildar, Pendurthi Mandal, Visakhapatnam District, and on receiving such representation, the Tahsildar shall objectively consider the same and pass appropriate orders in accordance with law.
5.
Subject to the above observations, the Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
