THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.13816 of 2012 ORDER:

Petitioner prays for the following relief:

"For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus under Article 226 of the Constitution of India declaring the action of the respondents in treating two sets of people who were situated on the same lines in delivering possession in Sy.No.165 of Meerpet (V), Saroornagar (M), R.R. District as being discriminatory, arbitrary, violative of the principles of natural justice, violative of Freedom of movement and right to life as guaranteed under Article 14, 19 and 21 of the Constitution of India apart from being atrocious and consequently direct the respondents to allow the members of the petitioner association to make constructions as per their budget and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Mr. Tulasi Das, learned counsel tried to persuade this Court to entertain the instant prayer and grant appropriate relief or mould the relief as the case may be. After arguing the matter for some time, learned counsel requested the Court to permit the petitioner to withdraw the Writ Petition to workout remedies if an order is passed by the respondents in terms of the order passed by this Court in Writ Petition No.22840 of 2003 before authorities by filing appeal or Writ Petition in this Court as the case may be.

The statement is not opposed by learned Assistant

Government Pleader.

Writ Petition is dismissed as withdrawn by granting liberty as prayed for.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
