THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.9886 of 2016 ORDER:

The criminal petition is filed under Section 482 r/w.457 Cr.P.C. to direct Jinnaram Police to release the JCB (vehicle fitted with construction equipment) vehicle bearing No.AP23-M9292 with Chassis No.1361093A2008 and Engine No.4H22510800581, which was seized in connection with Cr.No.102/2016 of Jinnaram P.S, Medak District, registered for the offences punishable under Sections 307, 448 & 427 IPC.

Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor, representing the State. The learned counsel for the petitioner is not in a position to state whether the vehicle in question is now in the custody of police or deposited before the concerned Court. Except seizure report, no other material is placed on record.

In the circumstances, the Criminal Petition is disposed of, permitting the petitioner to file appropriate application seeking release of the subject vehicle before the concerned jurisdictional Magistrate within a period of one month from today, and in such event, the learned Magistrate shall dispose of it on the same day, in accordance with law. Pending miscellaneous applications, if any, shall stand closed in consequence.
