HON'BLE SRI JUSTICE S.V. BHATT W.P. No.25956 OF 2015 ORDER:

The petitioner prays for Mandamus declaring the action of respondents in reflecting the status of land in an extent of Ac.61-00 in Survey No.5/ Part and Ac.4-45 cents in Survey No.6 covered by T.D.No.3072 of Narava Village, Pendurti Mandal, Visakhapatnam as 'Government Land' in the official website, as arbitrary, illegal and unconstitutional.

The subject matter of present writ petition admittedly is covered by a revision pending before the Commissioner of Appeals, Office of the Chief Commissioner of Land Administration, A.P. Now the dispute is between the petitioner claiming proprietary right in the subject matter of writ petition and the same is opposed by different grounds both by Revenue and Forest Departments. The Commissioner of Appeals has entertained revision against grant of patta and the revision is pending consideration before him, and this Court has directed the said authority to pass orders expeditiously preferably within two months. Continuation or deletion of present entries in revenue records is certainly depending on outcome of the revisions now pending before Commissioner of Appeals.

Therefore, at this juncture consideration of case of petitioner or the reply of respondents would prejudge the issue or result in prejudice to one or the other party.

Hence subject to outcome of the revisions, the petitioner is given liberty to seek execution of orders of Commissioner of Appeals in the maintenance of revenue records, if ultimately, it is held by the Commissioner of Appeals that the land is a private patta land.

The writ petition is disposed of accordingly. No order as to costs.
