THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10293 of 2015 ORDER:

This criminal petition is filed by the petitioner - Accused under Section 438 of Criminal Procedure Code seeking to grant bail in Crime No.168 of 2015 on the file of Annasagar Police Station, Mahaboobnagar District, registered for the offences punishable under Sections 376, and 506 IPC and 4 of POCSO Act. Heard and perused the material available on record. The allegation against the petitioner is that he committed rape on the de facto complainant, who is a minor.

Learned counsel for the petitioner submitted that the petitioner is innocent of the offense alleged against him and due to inimical terms between the petitioner's family and the de facto complainant's family, a false case was foisted against him and there was delay of one month in lodging the complaint.

Delay in lodging the complaint is not a ground to grant bail to the accused. Considering the seriousness of the allegations leveled against the petitioner, this Court is not inclined to grant bail to the petitioner.
