HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.14260 of 2015 ORDER:

This Writ Petition is filed challenging the inaction of the second respondent in selecting the petitioner as a fair price shop dealer. The second respondent filed a counter affidavit stating that notification was issued on 06.04.2015 to fill up the vacancy of fair price shop No.32, Machilipatnam, reserved for O.C. category; 16 applications were received and only 12 candidates attended for written test conducted on 22.04.2015; out of 12 candidates, 8 candidates were qualified for interview; among 8 candidates qualified for interview, the writ petitioner got 58 marks whereas the fourth respondent got 54 marks in written test; the petitioner secured 8 marks while the fourth respondent secured 15 marks in interview; and, thus, the fourth respondent secured more marks than the petitioner.

In view of the statement made by the second respondent in the counter affidavit, there is no ground to interfere with the appointment of the fourth respondent as a fair price shop dealer. The Writ Petition is, accordingly, dismissed. However, this will not prevent the petitioner from filing an appeal to the competent authority, if the rules permit.

Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. No order as to costs.
