HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.7685 OF 2018 ORDER:

The writ petition is filed for the following relief: "to issue an appropriate writ, order or direction more particular one in the nature of Mandamus declaring the action of the 2nd respondent in not disposing of Revision Petition No.D5/2986/2011 though the same was reserved for Judgment long back is highly arbitrary, illegal and contrary to law and consequently direct the 2nd respondent herein to pass orders in the said Revision Petition forthwith in the interest of justice."

In view of the nature of the relief sought for and the manner in which the present writ petition is disposed, notice to the unofficial respondent is dispensed with.

It is the case of the petitioner that he is the absolute owner and possessor of agricultural land bearing Sy.No.92 to an extent of Acs.3.35 guntas situated at Nerrapally Village, Ibrahimpatnam Mandal, Ranga Reddy District having purchased the same under an unregistered sale deed dated 06.10.1965 in the name of his wife, viz., Boddu Vijaya. Pattadar passbooks and title deeds were issued in her favour.

It is stated that due to misunderstanding between one Boddu Sugunamma and her four sons, they instigated the 3rd respondent to prefer an appeal before the Revenue Divisional Officer, East Division, Ranga Reddy District as against the pattadar passbook and title deed issued by the Tahsildar, Ibrahimpatnam in the name of his wife vide ROC/1524/90, dated 08.08.1990 in the year 2009. It is also stated that during the pendency of revision before the 2nd respondent, his wife died on 20.09.2015 and himself and his children were brought on record as her legal heirs in the Revision Petition No.D5/2986/2011 as

petitioner Nos.2 to 4 and the same was reserved for judgment. Hence, the present writ petition is filed.

In the above circumstances, this Writ Petition is disposed of without going into the merits of the case by directing the 2nd respondent to dispose of Revision Petition No.D5/2986/2011, as expeditiously as possible, preferably, within a period of four weeks from the date of receipt of a copy of this order.
