THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.15627 of 2010 ORDER :

This writ petition is filed to call for records relating to proceedings Roc.No.DA1/16263/2009 dated 23.03.2010 from the 1st respondent and after perusing the same, set aside the same by declaring it as arbitrary, discriminatory, illegal and contrary to the Govt. Memo No.25947/Endts.III/A2/2008-4 dt.16.06.2009 and consequently direct the 1st respondent to pay 10% cut imposed on the pension of the petitioner w.e.f. 1.8.2002, payment of the balance of salary for the period of his suspension from 28.09.2001 to 28.7.2002 by treating the said period as the period spent on duty, and with all other consequential benefits, monetary or otherwise.

When the matter is taken up, learned counsel for the petitioner represents that the cause in the writ petition does not survive.

Recording the said submission the writ petition is dismissed as infructuous. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
