Heard Sri T. Koteshwara Prasad, for the petitioner and the learned Assistant Government Pleader for respondent Nos. 1 & 2. 2.

The petitioner challenges the notice No. B/448/2017 dated 30.06.2017 under Andhra Pradesh Water, Land and Trees Act, 2002 (for short "the Act").

The petitioner complains that the notice dated 30.06.2017 and also the notice dated 6.5.2017 are substantially same and similar and the second respondent is pre-determined to seize the bore well drilled in S.No. 366 of Kondagadapa Village, Mothkur Mandal, Yadadri Bhongir District. 4.

I have perused the notice referred to above. Prima facie this Court is also of the view that the second respondent has more or less concluded the issue of seizing the bore well.

Be that as it may, since the challenge is notice issued under A.P. WALTA Act, 2002, and having regard to the stage of the matter and the defence the petitioner is having against the allegations in the impugned notice, this Court is of the view that to meet the ends of justice, the writ petition can be disposed of by this order:

The petitioner is given two weeks from today to file reply to the notice impugned in the writ petition by enclosing a copy of this order. The second respondent is directed to examine the reply and conduct enquiry as required by the Act and Rules made there under and take

SVB,J W.P.NO. 22182 OF 2017 decision expeditiously. Till a decision is taken and communicated, it is needless to observe that seizure of bore well is not affected. 7.

The Writ Petition is disposed of as indicated above. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
