AMARNATH GOUD I.A.No. 1 of 2018 in Crl.A.No. 1903 of 2018 & Crl.A.No. 1903 of 2018 JUDGMENT:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) This application is filed seeking to condone the delay of 111 days in filing the Criminal Appeal.

By virtue of the order dated 24.07.2018 passed by this Court, notice was sent to the respondents - accused. When the matter was taken up on 07.08.2018, neither proof of service of notice has been filed by the appellant nor anybody has appeared on behalf of the appellant. Same was the situation on 20.08.2018 and even today. It is, therefore, reasonable to presume that the petitioner-appellant is not interested in pursuing his cause in the present appeal. Hence, the present application is dismissed for nonprosecution. Consequently, the Criminal Appeal which is filed against the judgment of acquittal dated 12.09.2017 in S.C.No. 469 of 2015 delivered by VIII Additional Sessions Judge, Miryalaguda, is rejected.

As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
