HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.19180 of 2017 ORDER:

Heard Sri Giri Babu Marthi, for petitioner and the learned Assistant Government Pleader for respondents 1 to 4.

2. The petitioner complains against inaction of 2nd respondent in conducting survey to an extent of Ac.25.00 cents in Sy. No.184/ 6 (old Sy.No.8P) of Chippada village, Bheemunipatnam Mandal, Visakhapatnam District on the application made on 01.06.2017 and to direct respondents 3 and 4 to issue pattadar passbooks in favour of the petitioner, as illegal and arbitrary.

3. The Petitioner made a representation to the 2nd respondent on 01.06.2017 requesting to conduct survey and to direct the respondents 3 and 4 to issue pattadar pass books in his favour. The writ petition is filed on 13.06.2017. In the circumstances this court has difficulty to accept that there is delay or inaction on the application filed by the petitioner. The petitioner ought to give some reasonable and breathing time to the respondents to act in this matter. At this stage, the inaction complained is not made out. However, an opportunity is given to the petitioner to demand for compliance of survey and this court is of the view that 2nd respondent does the needful.

4. With the observation, the writ petition is dismissed. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
