HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.41507 of 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is preferred by the petitioner seeking the following relief: " .... to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the in action of respondent No.3 in not rectifying the records by deleting the wrong name Madanakka in the place of Mallakka is illegal, arbitrary, unconstitutional and consequently direct the 3rd respondent delete the wrong name MADANAKKA and incorporate GADIPALLI MALLAKKA in all relevant revenue records like online website Pahanies, Form 1-B (ROR) and pass such other order or orders as this Hon'ble Court may deem fit and proper in the interest of justice."

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue for respondents. With their consent, the writ petition is disposed of at the admission stage itself.

The case of the petitioner in this writ petition is that she made an application on 11.09.2015 before the Tahasildar to record her name in revenue records as 'Gadipalli Mallakka' in the place of 'Gadipalli Madanakka'. Pursuant thereto, the Mandal Revenue Inspector, Mahadevpur, conducted spot inspection over the subject land i.e. land admeasuring Acs.3.00 gts. in survey No.67/1 and Ac.0.05 gts. in survey No.73 situated at Palugula Village, Mahadevpur Mandal, Jayashankar District Bhupalpally, and recommended for change in name as sought by the petitioner.

However, till date no action is taken by the 3rd respondent. Hence, the present writ petition.

Learned AGP would submit that the 3rd respondentTahasildar may be directed to dispose of the representation of the petitioner, in accordance with law.

Having regard to the rival submissions made, the Writ Petition is disposed of directing the 3rd respondent-Tahasildar to deal with the representation submitted by the petitioner on 11.09.2015 seeking to correct her name in revenue records and dispose of the same in accordance with law, after duly verifying the records and hearing the petitioner and aggrieved persons, if any, as early as possible, preferably within a period of 4-6 weeks from the date of receipt of a copy of this order.
