This Writ Petition is filed for a Mandamus to declare the action of the 2nd respondent in withholding the allotment of essential commodities to the petitioner's fair price shop No.05023, Patharlapadu II, Chintakani Mandal, Khammam District as

illegal. The petitioner sought for a consequential direction to the 2nd respondent to allot the essential commodities to the said shop without reference to the proceedings in Rc.No.C2/2260/2011, dated 21.06.2011.

At the hearing, Mr.V.R.Avula, learned Counsel for the petitioner, submitted that the cause in this Writ Petition does not survive for adjudication and that the Writ Petition has become infructuous.

The above-submission of the learned Counsel for the petitioner is placed on record and the Writ Petition is, accordingly, dismissed as infructuous.

As a sequel to dismissal of the Writ Petition, interim order, dated 07-09-2011, is vacated and WPMP.No.30873 of 2011, filed by the petitioner for interim relief, is disposed of as infructuous.
