HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.3780 of 2015 ORDER :

This Criminal Petition is filed by the Petitioners/Accused Nos.1 to 7 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.101 of 2015 of II Town Police Station, Mahabubnagar, registered for the offence punishable under Sections 376 (1) 420, 498-A IPC Section 3 (1) (x), 3(2) (v)of SC/ ST (POA) Act, 1989.

2) Heard learned counsel for the petitioners/ accused Nos.1 to 7 and learned public prosecutor representing the 1st respondent - state before admission and before ordering any notice to the 2nd respondent-de facto complainant. Perused the material on record.

3) As the material falls short to the admit the proceedings filed in Criminal Petition under Section 482 Cr.P.C but for the facts even to admit entitlement of bail to the petitioners, since 1st petitioner/ accused No.1 concerned, he was already arrested and obtained regular bail and the main allegations are against accused No.1, the Criminal Petition is disposed of by giving liberty to the petitioners/ accused Nos.2 to 7 herein to surrender before the learned Special Judge and move for regular bail with notice to Assistant Public Prosecutor concerned, in such event the learned Special Judge shall consider and grant regular bail to the petitioners/ accused 2 to 7 after hearing the learned public prosecutor concerned, preferably on the same day atleast on the next day with necessary conditions. Needless to say pending investigation the personal appearance of the petitioners shall dispensed with unless specifically required with bail conditions.

4) Miscellaneous petitions, if any pending, shall stand closed.
