HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No. 3570 of 2021 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking quashing of the proceedings in C.C.No.1425 of 2020 on the file of the Judicial Magistrate of First Class (Special Mobile) at Karimnagar.

A charge sheet came to be filed against the petitioners for the offences punishable under Sections 332, 341, 353 read with Section 34 IPC and Section 67 of the I.T.Act, 2000.

Though the present Criminal Petition is filed seeking quashing of entire proceedings, but learned counsel for the petitioners restricts his prayer seeking dispensation of the presence of the petitioners before the trial Court on every date of adjournment. 4.
The learned Public Prosecutor submits that since the identity of petitioners is not in dispute, their presence in the above C.C. may not be necessary on every date of adjournment. 5.
Having regard to the facts and circumstances of the case, the personal appearance of the petitioner Nos.2 to 4/accused Nos.2 to 4 in C.C.No.1425 of 2020 on the file of the Judicial Magistrate of First Class (Special Mobile) at Karimnagar, is hereby dispensed with except on the dates when their presence is specifically required by the Court. However, petitioner No.1/accused No.1 shall appear before the concerned Court.

With the above direction, the Criminal Petition is disposed of. As a sequel thereto, Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
