THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.12114 of 2011 ORDER:

The relief sought for in the writ petition is for a mandamus to declare the action of the respondents, in causing hindrance/interference at the time of harvesting the fish by the members of the society in Ura Cheruvu of Mutharam Village, Mudigonda Mandal, Khammam District in the year 2010-11, as arbitrary, illegal, contrary to G.O.Ms.No.776 dated 31.12.1990, against the lease deed dated 24.11.2010, and the fishing order dated 24.02.2011.

By way of interim relief the petitioner sought a direction, in W.P.M.P.No.14810 of 2011, to respondents 1 and 2 not to cause hindrance/interference with the fishing operations of the society for the year 2010-11. By order dated 20.04.2011, interim direction, as prayed for was granted.

As the year 2010-11 has already expired and, pursuant to the interim order passed by this Court, the petitioner must have already harvested the fish in the tank, it is evident that the cause in the writ petition no longer survives necessitating any further adjudication by this Court.

The Writ Petition fails and is, accordingly, dismissed.

Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
