HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.27829 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the respondents in not considering and granting sawmill licenses to the petitioners as illegal and arbitrary.
2 Heard the learned counsel for the petitioner and the learned Government Pleader for Forests.
3 A perusal of the record reveals that the petitioners are intending to start sawmills at Gajuwaka and Patipalli villages of Visakhapatnam District. The petitioners submitted a representation to the 5th respondent on 03.05.2016 requesting to grant permission to start sawmills. 4 At the time of arguments, the only relief sought by the learned counsel for the petitioners is to direct the 5th respondent to consider and dispose of the representation dated 03.05.2016 submitted by the petitioners as expeditiously as possible. The learned Government Pleader also consented for the same. In view of the submissions made by the learned counsel for both the parties, this Court is not inclined to go into the merits of the main case.
Having regard to the facts and circumstances of the case and the submissions of the learned counsel for both the parties, the 5th respondent is hereby directed to dispose of the representation of the petitioners dated 03.05.2016 in accordance with law as expeditiously as possible, preferably, within a period of two weeks from the date of receipt of a copy of this order. 7 With the above direction, this writ petition is disposed of No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
