THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY SECOND APEPAL No.895 OF 2004 JUDGMENT:

Sri K.A. Narasimham, learned counsel appearing for the first respondent, filed a memo informing about the death of the second respondent in appeal on 23.12.2015 enclosing the copy of the death certificate dated 29.12.2015 issued by the Birth and Death Registrar, Village Secretariat, Jagapathi Nagaram, Kirlampudi Mandal.

As on today the appeal against the second respondent is abated by operation of law, but the appellant did not take steps to implead the legal heirs of the second respondent. Despite listing the matter under the caption for dismissal, there is no representation for the appellant.

Hence, the appeal is dismissed for non prosecution, but without costs.

Miscellaneous petitions, if any, pending in this appeal shall stand closed.
