M/S Shree Gouraavi Plastic Limited (In Liqn) v. Stressed Assets Stabilisation Fund (Sasf)

THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM COMPANY APPLICATION No. 21 OF 2019 O R D E R :

This Application has been taken out under Section 457(1)(c) of the Companies Act, 1956 read with Rule 9 and 11(b) of the Companies (Court) Rules, 1959 seeking the following relief: i) post the Company Application No. 632/2018 in RCC No. 1/2012 before the Hon'ble Company Court under the caption "for being mentioned". ii) modify the order for the relief No.8 in C.A.No. 632 of 2018 is concerned the 1st respondent herein to deposit an amount of Rs.5,00,000/- with the Official Liquidator to incur the advertisement charges, e-auction fee and other incidental expenses within 100 days from the date of the order; which shall be reimbursed by the Official Liquidator upon sale of the assets of the company (in liqn) on priority basis subject to the order of this Hon'ble Court.

iii) order that the cost of this Application do come out of the funds of the company (in liqn.) Heard learned counsel for the applicant.

For the reasons stated in the accompanying affidavit, the Application is ordered.
