HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.27639 OF 2009 O R D E R :

The petitioner challenges the action of the respondents in deducting the provident fund, EDLF contribution, administrative and inspection charges from the bills payable to him.

The petitioner was awarded a contract of cleaning and washing of buses along with parking duties at Puttaparthy depot of APSRTC. Some persons are engaged in the contract. While paying the bills, the Corporation, i.e. respondents 1 to 3, sought to deduct the amounts referred to above. The petitioner contends that the liability to pay the said contribution does not necessitate and the deduction cannot be sustained in law. Heard learned counsel for the petitioner and the learned standing counsel for the respondents.

The question, that arises for consideration in this writ petition, was dealt with by this Court in W.P. No.905 of 2009 and batch, and through judgment dated 12.08.2009 those writ petitions were allowed.

Following the same, this writ petition is also allowed as prayed for. There shall be no order as to costs. Miscellaneous petitions pending if any shall stand closed. ______________ S.V. BHATT, J Date:04.07.2016 Stp
