Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

Having regard to the facts involved in this case, it is not a fit case to quash the proceedings. However, the Police are directed to strictly follow the procedure contemplated under Section 41 (a) of Cr.P.C. during the course of investigation.

This Criminal Petition is disposed of accordingly. As a sequel, miscellaneous applications pending if any, shall stand closed.
