THE HON'BLE SRI JUSTICE S.V.BHATT C.R.P. No.1868 of 2018 ORDER:
The prayer of the petitioner for receiving in evidence, the attested copy of the 1-B Extract in respect of land in Sy.No.174, measuring Ac.1-32 guntas, situated at Dhulikatta Siwar of Eligedu Mandal, dated 23.12.2017 is rejected by the trial Court. Hence, the Civil Revision Petition. Ms.P.Padmavati contends that by permitting the petitioner herein to get the Extract of 1-B register on record, no prejudice is suffered and it helps the Court in deciding the issue.
I have perused the record. The gist of the Court's observation is that the suit is of the year, 2011. The affidavit filed in I.A.No.105 of 2018 suffers from too much brevity and in the process does not advert to omission, for not filing the very extract at the earliest point of time or atleast when the suit is pending for seven years.
For valid reasons, the prayer is rejected by the trial Court. No ground is made out warranting interference of this Court under Article 227 of Constitution of India. The Civil Revision Petition fails and accordingly dismissed. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
