Aggrieved by the award dated 24-07-2000 passed by the Labour Court - III, Hyderabad, in I.D.No.263/ 1997 in so far as denying back wages, the petitioner - workman of the respondent - Corporation, filed the present writ petition.

Heard the learned counsel for the petitioner and the learned Standing Counsel for the respondent - Corporation.

From the material on record, it could be seen that the petitioner was working as Driver in the respondent - Corporation and on the charges of unauthorized absence from duty, was terminated from service. On unsuccessfully availing the departmental remedies of appeal and review, petitioner preferred I.D., and by the impugned award, the Tribunal, appreciating the evidence on record, did not agree with the findings of the inquiry officer with regard to guilt of the petitioner and accordingly modified the order of removal to that of reinstatement with continuity of service, with attendant benefits, but without back wages.

This court, having considered the submissions made by the learned counsel parties, is of the considered view, that the Labour Court rightly passed the award. Moreover, the learned counsel for the petitioner has not pointed out any illegality or irregularity in the impugned award and in the absence of the same, the impugned award cannot be interfered with, and

the writ petition is devoid of any merits and the same is accordingly dismissed.
