HON'BLE SRI JUSTICE A. SHANKAR NARAYANA A.S.No.1154 OF 1996 JUDGMENT:

The present appeal relates to the year 1996, arising out of the judgment and decree, dated 27.10.1995, in O.S.No.42 of 1989 on the file of Additional Subordinate Judge, Srikakulam, decreeing the suit for Rs.3,00,000/- with interest against defendant Nos.1 and 2, and the present appellant is defendant No.1.

2. Though, the appeal relates to the year 1996 and despite listing the matter in advance list and again re-notifying it in the present list, there is no representation for the appellant. It appears, the appellant is not interested to prosecute the present appeal.

3. Across the bar, it is stated that Sri S. Kishore, learned counsel for the appellant, is no more. However, it is for the appellant to evince interest in appointing a counsel to prosecute the appeal, which he did not do.

4. Hence, the present appeal is dismissed for non-prosecution. Miscellaneous Petitions, if any, pending in this appeal shall stand closed. There shall be no order as to costs.
