ORDER:

The case of the petitioner is that initially the individuals of Pernamitta village have been given pattas an extent of Ac.1.00 cent each in Sy.No.238 on payment of Rs.150/- per acre and D Form pattas were also issued to them on 14.04.1990. After enquiring with the 4th respondent-Tahsildar and obtaining NOC from him, the petitioner purchased an extent of Ac.5.00 cents in Sy.No.238/1 of Pernamitta village of Santhanuthalapadu Mandal Prakasam District, from the said beneficiaries on 11.12.2006. When the 4th respondent issued notice dated 26.04.2007 to vacate the

land, the petitioner filed W.P.No.16352 of 2007 before this Court. Initially this Court ordered stay of dispossession, and later, the writ petition was disposed of directing the 4th respondent to pass appropriate orders on the objections filed by the petitioner to the notice dated 26.04.2007. Even though there was a direction by this Court the 4th respondent without considering his objections passed orders 15.02.2013. Aggrieved by the same, the petitioner filed an appeal before the 3rd respondentRevenue Divisional Officer, who rejected the appeal. As against the same, the petitioner filed another appeal before the 2nd respondent along with a petition for stay of the order of the 4th respondent. As no orders are passed by the 2nd respondent the petitioner filed the present writ petition. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue (A.P.) for respondents.

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 2nd respondent to pass appropriate orders either in the stay petition or in the appeal filed by the petitioner within a period of three months from today. Pending disposal of the revision petition, there shall be stay of all further proceedings pursuant to the order passed by the 4th respondent dated 15.02.2013. With the above direction, the writ petition is disposed of. No costs. As a sequel, miscellaneous petitions, if any, shall stand closed. _____________________ CHALLA KODANDA RAM, J.
