THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.32223 of 2017 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to declare the action of the respondents in trying to dispossess the petitioners from their respective lands, as illegal and arbitrary.
When the matter is taken up for hearing, the learned Government Pleader for Revenue submits that as per the instructions received from the Revenue Divisional Officer, Gajwel, the lands, which are the subject matter of dispute in this writ petition, are not required to be acquired.
Relevant portion of the instructions received from the Revenue Divisional Officer, Gajwel, are extracted hereunder: "....... Further, the Dy & EE (R&B) has informed that they have not forming or laying any road in the present writ petitioner land and they will form the road after completion of Land Acquisition Process."
Recording the said statement, the writ petition is disposed of. However, it is needless to mention that if the authorities intend to take any action, the same shall only be in accordance with law.
