ORDER
This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused in connection with Crime No.134 of 2025 of Karepalli Police Station, Khammam District, registered for the offences punishable under Sections 296(b), 118(1), 118(2) and 351(2) read with 3(5) of BNS.

The brief facts of the case are that, on 13.05.2025 the de-facto complainant, lodged a report before the police stating that on 10.05.2025, at about 20:00 hours, he and his wife went to his younger brother's house and called out to him to inform that his son and daughter-in-law had gone to the hospital for treatment of their injuries. It is alleged that, at that time, Accused Nos.1 to 10 arrived carrying sticks and stones in their hands, abused the complainant and his wife in filthy language, pushed the complainant to the ground, and beat him with sticks. When his wife tried to intervene, the accused persons beat her with sticks as well, causing severe bleeding injuries. Hence, the complainant requested the police to take necessary action. Based on this report, a case was initially registered against the accused under Section 118(1). Later, upon receipt of the injury certificate, Section 118(2) was also added. 3.
Heard Sri G. Sundaresan, learned counsel appearing on behalf of the petitioner, and Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioner submitted that the petitioner is arrayed as Accused No.6 and that there are no specific allegations against him. He further contended that the petitioner is a student and, due to disputes between LW.1 and Accused Nos.7 and 10, a false case has been registered against him. The only allegation is that Accused Nos.1 to 10 collectively assaulted the complainant and his wife, but there is no specific overt act attributed to Accused No.6. He further contended that initially Accused No.10 lodged a report against the complainant and his family, and as a counterblast, the present case was filed and that the petitioner is ready and willing to cooperate with the investigation. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing the present Criminal Petition. 5.
On the other hand, learned Additional Public Prosecutor opposed the submissions, contending that the allegations against the petitioner are severe and heinous in nature and that the injury certificate filed by the complainant clearly shows that the injuries sustained are grievous in nature and that the investigation is still incomplete. Hence, the petitioner is not entitled to bail, and prayed for dismissal of the Criminal Petition.

In light of the submissions made by both learned counsel, and upon perusal of the material available on record, it is evident that the petitioner is arrayed as Accused No.6 and there exists a case and counter cases against the parties. Considering the overall facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner - Accused No.6, subject to the following conditions:
i.
The petitioner shall surrender before the Station House Officer, Karepally Police Station, Khammam District within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.15,000/- with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m. for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
