THE HONOURABLE SRI JUSTICE DILIP B.BHOSALE CIVIL REVISION PETITION No.60 OF 2014 P.C.:

This Civil Revision Petition, by the Judgment Debtor, is directed against the order dated 02.01.2014 passed in E.P.No.25 of 2009 in O.S.No.1825 of 2006. The E.P., filed by the respondent-decree holder for issue of warrant of possession of the suit schedule property on the basis of the decree passed by the Court below, has been allowed by the impugned order.

Learned counsel for the petitioner-judgment debtor submits that the plaintiff-decree holder has executed a registered sale deed in favour of the judgment debtor's daughter and she also put the daughter in possession of the suit schedule property long back. On a specific query made by the Court, learned counsel for the petitioner submits that the petitioner is not in possession of the suit property. The daughter of the petitioner has not filed any petition challenging the impugned order. Her application under Order XXI Rule 97 to 101 of the Code of Civil Procedure is, however, pending before the Court below. Keeping that in view I find no merit in the present Civil Revision Petition. Hence, the CRP is dismissed. Miscellaneous petitions pending in the Civil Revision Petition, if any, also stand disposed of.
