Heard learned counsel appearing for the petitioner and learned Standing Counsel appearing for the respondent-Corporation.

An identical issue fell for consideration before this Court in W.P.No.12259 of 2011 and learned single Judge while disposing of the same held as under:

"As per the record, the entire selection process was over.

But, according to the learned counsel for the petitioners some of the vacancies which are notified in pursuance of the notification dated 1.11.2010 have not been filled up by the respondents. Therefore, the case of the petitioners may be considered in case any selected persons have not joined in pursuance of the notification of the respondents dated 1.11.2010.

Having regard to the facts and circumstances of the case, if rules and regulations of the respondentsCorporation permit them, they can reconsider the case of the petitioners for the appointment of the posts of Shramiks in the case any selected persons have not joined in pursuance of the selection

notification dated 1.11.2010."

In view of the same, this writ petition is also disposed of in terms of the above said order. The respondents are directed to consider the case of the petitioner for appointment as Shramik subject to availability of the vacancies, which arise on account of non-joining of any candidate and as per the rules and regulations of the Corporation. No costs. Miscellaneous petitions, if any, pending shall stand closed.
